It's supposed to do that, if you upgrade your lvl 3 barracks one more time, it get bigger and take up the spaces of the lvl 1 barracks.

When you want to upgrade your barracks from lvl 8 to 9 you'll have to build 5 lvl 1 barracks yourself, so remember how they're located now and you'll have a better idea of what to do when it's time.

how would i do that

Go to the map, find a town that says it's owned by noCommander or look for towns that aren't as bold or dark in color as your town, click on it, that will take you to it's profile and then click attack town.

do you get a error?

It takes a few weeks of player inactivity for their town to be grayed out, so, just because the town might not have any points doesn't mean the player is considered inactive yet.

It's not months but something like that.
