i have enough stuff for a highway man and the mercenaries points but it wont work. it is grey like when you havent got the level of the barracks high enough.

Yes, to hire mercenaries they must first travel to your city looking for work. It is a random thing, wait a day or two and check again. Or you may pay 50 gold for many mercenaries to be temporarily available.
